The essential point

Who signs the lease?

The lease is signed between the owner and the tenant. That direct contractual relationship is protected by Quebec law and remains fully your prerogative.

AA Location is never a signing party to the lease. Our real-estate broker acts as a professional intermediary and facilitator — preparing documents, explaining clauses, coordinating the meeting and witnessing the signing.

The roles, in plain terms

You

Owner — signing party

You keep the direct contractual relationship with the tenant and all of your rights.

The tenant

Tenant — signing party

Commits to you, in line with the TAL lease and the agreed-upon annexes.

Coordinating broker

An OACIQ-registered real-estate broker prepares, explains, and coordinates. Without signing.

Legal framework

The TAL lease — Quebec's mandatory form.

Since 1996, every residential lease in Quebec must be drawn up on the mandatory form of the Tribunal administratif du logement(formerly the Régie du logement). It's a standard that protects both parties and covers the essential elements of a valid lease.

Our broker always uses the official, up-to-date version — including the mandatory sections on rent fixing, unit conditions, and renewal terms.

A lease drawn on a form other than the TAL's is not compliant. Our broker guarantees the use of the right form and the inclusion of the required sections.

Recommended lease annexes

  • Annex — Building rules

Quiet hours, pets, common areas. Especially important for condos and duplexes.

  • Annex — Unit condition report

Detailed inventory of the condition at move-in. Protects both parties when the tenant leaves.

  • Annex — Tenant insurance

Requirement for liability and contents coverage. Recommended for any Quebec lease.

  • Annex — Rent payment terms

Method (post-dated cheques, transfer, automatic payment), payment date, terms.

  • Annex — Inclusions and exclusions

Heating, electricity, hot water, appliances, parking, locker — what's included in the rent.

  • Annex — Co-ownership rules (condo)

For condos: syndicate rules enforceable against the tenant. Annexing prevents later conflicts.

From candidate selection to signing — how it goes.

Once the candidate is selected and the file verified, our broker handles the signing coordination in four clear steps.

3

Who signs the lease in Quebec?+

The lease is signed between the owner and the tenant. AA Location is never the signing party — our real-estate broker coordinates, prepares the documents, explains the clauses, and witnesses the meeting. You remain the signing owner and keep all of your rights.

Is the TAL lease mandatory in Quebec?+

Yes. Since 1996, every residential lease in Quebec must be drawn up on the mandatory form of the Tribunal administratif du logement (TAL), formerly the Régie du logement. Our broker always uses the official, up-to-date version.

Which annexes are recommended for the lease?+

Depending on your situation: building rules, unit condition report, tenant insurance requirement, rent payment terms, inclusions/exclusions, and co-ownership rules for condos. Our broker proposes the annexes relevant to your case.

Can the signing happen remotely?+

Yes. Electronic signatures are legally recognized in Quebec. Our broker can coordinate an in-person, video, or secure e-signature meeting — based on your and the tenant's preference.

What if the tenant wants to modify a clause?+

Any modification to the TAL lease must be negotiated and accepted by both parties before signing. Our broker supports you in that discussion, ensuring your interests are protected and the modifications comply with Quebec law.

How long does the lease signing take with your support?+

The signing meeting itself usually takes 30 to 60 minutes. Document preparation upstream takes 2 to 5 business days after the candidate is approved — we can accelerate if needed.

Are you required to be neutral between the parties?+

Our broker operates within OACIQ rules. Since we represent the owner first under the placement mandate, our obligations toward the chosen candidate are those of honesty, professional loyalty, and fair information — without dual representation.

What happens after the signing?+

You receive every signed document in digital format. You keep the direct relationship with the tenant for rent collection and day-to-day management. If you'd like to delegate those, our property management service is available as an option.
